MyESign · Legal
Terms of Use
Draft v1 — 2026-10-17 — pending legal review
Version 1 · Applies to MyESign at myesign.app, the MyESign app and the MyESign API
These Terms of Use are an agreement between you and SocialDNA Systems LLC for the use of MyESign. They apply to senders (people and teams with a MyESign account, including through the API) and, where stated, to signers (people who receive a document to sign). Please read them with our Privacy Policy and Personal Data Declaration. By creating an account, sending an envelope or signing a document with MyESign, you accept these terms.
1. About these terms
- MyESign is a socialDNA product provided by SocialDNA Systems LLC, a Virginia limited liability company ("we", "us").
- The English version of these terms is the only binding version. Translations are a courtesy; if they differ, the English version prevails.
- Nothing in these terms takes away rights that the law says cannot be waived, including consumer rights in the EU, the UK and Brazil.
2. Accounts and teams
- You must be at least 18 and able to enter into a contract to create an account. If you use MyESign for a company, you confirm that you may bind it, and "you" includes that company.
- Envelopes belong to a team. People of the team can send its envelopes; only the team's owners and managers can create API keys and webhooks. You are responsible for who you add to your team and for everything done with your account, your keys and your team.
- Keep your password and API keys secret, and tell us at once if you think someone else is using them.
- Signers do not need an account. A signing link is personal to the person it was sent to and must not be forwarded.
3. The service
MyESign lets you upload a PDF (up to 25 MB), place fields, invite up to 10 signers per envelope in order or all at once, collect typed, drawn or voice signatures, and receive the signed PDF sealed with a certificate and saved to your team's DOCZ. It includes an API, an embeddable sign button and signed webhooks.
| Feature | Status today |
|---|---|
| Invitations by email and personal link | Available |
| Invitations by WhatsApp | Available when our WhatsApp sender is active; a failed delivery is shown to the sender |
| Invitations by text message (SMS) | Not active yet — our toll-free number is waiting for carrier verification. After that, only to numbers with recorded consent |
| Signing by recorded phone call (voice signature) | Available for United States numbers, in English, up to 6 minutes per call |
| Identity verification before signing | Optional; needs socialDNA ID active for your team |
| Printed copy by USPS Certified Mail (PostKite) | The request is recorded; mailing starts when PostKite's USPS labels are approved |
| Templates, contact import, automatic reminders, iPhone app | Coming soon |
Features may change, be added or be removed. We do not promise that the service will always be available or that every invitation will be delivered — email, WhatsApp and phone networks are run by others.
4. Pricing and payment
- US$1 per signature. No monthly fee, no annual contract, no envelope limit. A document with two signers costs US$2.
- A signature is charged only when that person signs. Envelopes that nobody signs, declined invitations and voided envelopes cost nothing. The same signature is never charged twice.
- Everything is included: field editor, all invitation channels that are active, voice signatures, the certificate and seal, DOCZ storage, the API, the sign button and webhooks.
- Optional add-ons are priced separately and shown before you choose them — today, a certified mail copy by PostKite at US$11.95 per envelope, once available.
- Each signature is recorded as a usage line on your team's billing account, which you can check in the app. Card payments are processed by Stripe; we never see or store your full card number. The app shows how and when your usage is collected before any charge is made.
- Prices do not include taxes that may apply. We may change prices with at least 30 days' notice; a change never applies to signatures already made.
- If you think a charge is wrong, write to us within 60 days and we will review it.
5. The sender's responsibilities
If you send envelopes, you agree that:
- you have the right to send the document and to share the signers' names, emails and phone numbers with us for this purpose, and you have told them as the law requires;
- the contact details are correct and belong to the people who must sign;
- for WhatsApp, text messages and phone calls, you have each signer's prior permission to contact them at that number for this document. A signing call uses an AI (artificial) voice and is recorded, so you must have the permission the law requires for such calls (in the United States, including under the Telephone Consumer Protection Act and state laws). Invitations are transactional — never use them for marketing;
- you decide whether an electronic signature is appropriate for your document. Some documents cannot be signed electronically or need extra formalities — for example wills, codicils and testamentary trusts, many family-law documents, court orders and notices, notices of utility cancellation, default, foreclosure or eviction, and documents that must be notarized or witnessed. MyESign does not provide notarization;
- for consumer transactions, you give signers the information and the choices that the law requires before they agree to use electronic records — the disclosure in section 6 is provided to help, and you remain responsible for it;
- you provide a paper copy of the signed document to a signer who asks for it, and you act on a signer's request to withdraw consent or to update contact details (section 6).
6. Electronic records and signatures — disclosure for signers
Please read this before you sign. It explains your rights when you agree to receive and sign documents electronically through MyESign, under the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. 7001) and the Uniform Electronic Transactions Act (UETA) as adopted by the states.
6.1 What you agree to
When you tick "I agree to use electronic records and signatures" on the signing page, or say "I agree" with your full name on a recorded signing call, you agree that the document in that envelope, the signing record and the signed copy may be provided to you electronically, and that your electronic signature has the same legal effect as a handwritten signature. Your consent covers only that envelope and the records about it, unless the sender tells you otherwise.
6.2 You can choose paper
You do not have to sign electronically. You may ask the sender — the business that sent you the document — for a paper copy of the document, or to sign on paper instead. MyESign does not charge signers anything; any fee for paper copies is set and disclosed by the sender.
6.3 How to withdraw your consent
Before you sign, you can withdraw at any time: tap Decline to sign on the signing page (you may say why), or end the call without saying "I agree". After you sign, tell the sender directly that you withdraw your consent to electronic records. Withdrawing does not undo signatures already made and records already delivered; the sender may then need to continue on paper.
6.4 What you need
- A device with internet access and a current version of a common web browser (for example Safari, Chrome, Edge or Firefox) with JavaScript turned on.
- An email account, a WhatsApp account or a mobile phone able to receive the invitation, depending on the channel the sender chose.
- A program that opens PDF files, and a way to save or print them, to keep your copy.
- For signing by phone: a phone line with a United States number.
If these requirements change in a way that affects your ability to access or keep the records, we will tell you, and you may withdraw your consent without any fee.
6.5 Keeping a copy
When everyone has signed, the signing page offers Download the signed PDF, sealed with its certificate. Save or print it. You can open your link again later to download it, and you can also ask the sender for a copy.
6.6 Updating your contact details
Your email and phone number were given to us by the sender. To change them, contact the sender; we cannot change them on the sender's behalf. You can also write to us and we will pass your request to the sender.
6.7 Your link and your records
Your link is personal. Do not forward it. When you sign, we record the time, your IP address, your browser, the method and your consent, and print them on the certificate that every party receives (see the Privacy Policy).
7. Voice signatures by phone call
- A signing call is made by an AI assistant that says it is an AI and that the call is recorded, confirms who is speaking and describes the document using only its title and the sender's message. It never invents terms, prices or dates.
- A voice signature is made only when the signer clearly says "I agree" and their full name. If the signer refuses, hesitates, wants to read first or the name does not match, nothing is signed and the written link keeps working.
- The recording, the transcript and the call details become part of the signing record; the last lines of the transcript are printed on the certificate.
- Speech recognition can make mistakes. The signer should read the full document from the link before agreeing; the sender is responsible for the accuracy of the summary it writes.
- Do not use voice signatures where the law requires a written or handwritten signature, a witness or a notary.
8. Identity verification
When a sender requires it, a signer must pass a socialDNA ID verification (a driver license scan and a selfie) before signing, and the result is printed on the certificate. Identity verification is an aid to your decision, not a guarantee: it does not prove that a document is genuine, and our face engine is not a certified liveness test. socialDNA ID is provided under its own terms.
9. What the certificate shows — and what it does not
| The sealed PDF shows | How |
|---|---|
| Integrity: the document and signatures have not changed since sealing | A SHA-256 seal over the envelope, the original document fingerprint and every signature, plus the SHA-256 of the final PDF |
| Time: when it was sealed | An RFC 3161 timestamp from an independent authority (freetsa.org), when available at sealing time — the certificate says if it was not |
| Who, how and when: each signer's name, contact, time opened and signed, IP address and method | The signing record kept by MyESign and printed on the certificate page |
| Consent: each signer agreed to use electronic records | The consent recorded at signing |
The certificate is evidence; it is not a guarantee. It does not prove who was physically using the device or the phone, that the document is lawful, or what a person understood. Whether a signed document is valid, enforceable or accepted as evidence is decided by the court or authority that receives it under its own rules. We do not guarantee that any document or certificate will be accepted.
10. API, sign button and webhooks
- API keys start with
es_live_, are shown once and can be revoked at any time. Keep them on your server — never in a web page or an app that others can download. - Anything done with your key is done by your team and is charged to your team.
- Webhooks are signed with your endpoint's secret in the
MyESign-Signatureheader (t=…,v1=…, HMAC-SHA256 of the timestamp and the body). Check the signature before trusting a message. We attempt each delivery once, with a short timeout; use the API to confirm an envelope's status. deliver: falsecreates the links without sending any invitation — use it for tests.- We may limit the rate of requests to protect the service. You are responsible for your integration and for what your systems do with the data they receive.
11. Your content
- The documents you send and the data in them are yours (or your signers'). We claim no ownership of them.
- You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and transmit your content only to provide MyESign — to deliver the envelope, collect the signatures, seal and store the result and show it to the parties.
- We do not use your documents to train AI models and we do not sell them.
12. Acceptable use
You agree not to use MyESign to:
- send documents you have no right to send, or collect signatures through deception, pressure or impersonation;
- sign for someone else, or use another person's link, phone or identity;
- send spam, marketing or unlawful content through our invitations;
- call or text people without the permission the law requires;
- commit fraud or break the law, including sanctions and export rules;
- attack, overload or interfere with the service, bypass its security or limits, or access data that is not yours;
- copy, reverse engineer or resell MyESign, except where the law expressly allows it.
We may block invitations, limit features or suspend accounts that break these rules, and we may report illegal activity to the authorities.
13. Ending your use and account deletion
- You can stop using MyESign at any time. To delete your account, see Delete your account. Sign-in stops at once; signatures already made remain payable.
- Sealed documents and their signing records may need to be kept for the other parties and as evidence — what happens to them is described in the Privacy Policy. Download the sealed PDFs you need before you leave.
- We may suspend or close an account — with notice when possible — if it seriously or repeatedly breaks these terms, if the law requires it, or to protect people or the service. If we close an account without fault on your part, we will give you a reasonable time to download your documents.
- If we stop offering MyESign, we will give at least 60 days' notice and time to download your documents.
- Sections that by their nature should survive (including 6, 9, 11 and 14 to 22) continue after your account ends.
14. Our intellectual property
MyESign — its software, design and content other than yours — belongs to SocialDNA Systems LLC or its licensors. MyESign and socialDNA are our trademarks. We give you a limited, non-exclusive, non-transferable and revocable right to use MyESign under these terms. If you send us ideas or feedback, we may use them without any obligation to you.
15. Third-party services
MyESign relies on services we do not control — email, WhatsApp, phone and text networks, speech and AI providers, the payment processor and the time-stamping authority (see the Privacy Policy). We are not responsible for their outages or for how they operate, but we choose them carefully and limit what they receive.
16. Disclaimer of warranties
To the maximum extent permitted by law, MyESign is provided "as is" and "as available". We do not warrant that invitations will be delivered, that calls will connect, that the service will be uninterrupted or error-free, that a transcript will be exact, or that a signed document will be valid, enforceable or accepted as evidence in any particular case. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Your statutory consumer rights are not affected.
17. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the use of or inability to use MyESign — including undelivered invitations, failed calls or a document found invalid; and (b) our total liability for all claims relating to MyESign is limited to the greater of the amount you paid us for MyESign in the 12 months before the claim and US$100.
These limits do not apply to liability that cannot be limited by law — such as for death or personal injury caused by negligence, fraud, gross negligence or willful misconduct — or to mandatory consumer rights.
18. Indemnity
To the extent permitted by law, senders agree to defend and indemnify SocialDNA Systems LLC and its members, employees and agents against third-party claims, and related costs including reasonable attorneys' fees, arising from their documents, their invitations (including calls and messages made without the required permission), their breach of these terms or their violation of the law or of someone else's rights.
19. Governing law
These terms are governed by the laws of the Commonwealth of Virginia, USA, and applicable US federal law, without regard to conflict-of-law rules. If you are a consumer living in the EU, the UK, Brazil or another country whose law gives you mandatory protection, you keep that protection and may also bring proceedings where you live.
20. Dispute resolution
- Talk to us first. Before starting a claim, write to privacy@socialdna.app describing the problem and what you are asking for. We will try to resolve it within 60 days.
- Courts. If we cannot resolve it, the dispute will be decided by the state or federal courts located in Virginia, except where the law lets you sue where you live. Either of us may instead use small-claims court if the claim qualifies.
- Time limit. Where the law allows, a claim must be brought within one year after it arises.
21. Changes to these terms
We may change these terms as MyESign evolves. For important changes we will tell senders in the app or by email at least 30 days before they take effect. If you do not agree, you can stop using MyESign before the change applies. A change does not affect envelopes already signed.
22. General
- These terms, the Privacy Policy and the Personal Data Declaration are the entire agreement between you and us about MyESign.
- If a provision is found invalid, the rest remains in force. If we do not enforce a provision, we do not waive it.
- You may not transfer these terms without our consent. We may transfer them to a company that takes over MyESign, with notice to you.
- We are not responsible for failures caused by events beyond our reasonable control.
- We may send senders notices in the app or by email to the account address. You may send notices to privacy@socialdna.app.
